To me that's called crime, because that behavior not only hurt fellow citizens but also creates fears toward that right that drives people to not use it just to avoid to misuse it. A key aspect to this (at least I think so) is that this is one of several ways of enforcing the (in?)famous Golden Law out there: treat others as you want others to treat yourself.
